These are actions taken by the State or Territory regulatory authorities when a service is found to be not complying with National Health and Safety regulations. These actions range in severity and are designed to improve and ensure children’s safety and wellbeing.

What is an enforcement action?

The regulatory authority may amend the provider or service’s approval to operate.

Compliance notices or directions include formal instructions for a service to rectify compliance issues.

Conditions placed on a service or provider approval require the service or provider to undertake specific actions to be compliant.

 – Emergency action notices require immediate steps to be taken by the provider to address serious risks at a service.

 – Enforceable undertakings are legally binding agreements that can be made between a regulatory authority and an approved provider or an individual. They set out what that approved provider or individual agrees to do or refrain from doing to comply with the National Law.

 – In extreme cases, the provider or service may temporarily lose their approval to operate.

Definitions

The Approved Provider must continue to engage a management company. The Approved Provider has engaged Aced It Childcare Consultants to support the operations of the education and care service.

The Approved Provider must notify the Regulatory Authority within 7 days if the approved provider ceases to engage Aced It Childcare Consultants as a management company.

Where the Approved Provider ceases to engage an existing management company, the Regulatory Authority requires the Approved Provider to immediately engage a new management company. In addition to notifying the Regulatory Authority, the Approved Provider must submit to the Regulatory Authority within 7 days of ceasing the existing management company, a copy of the new agreement/contact between the Approved Provider and the new management company.

It is a condition of the service waiver that the approved provider must utilise 201.1m² of covered space on the ground floor, to satisfy part of the unencumbered outdoor space requirements

It is a condition of the service waiver that an additional staff member is on duty above minimum ratios (in regulation 123 of the Education and Care Services National Regulations) at all times the alternative space is being used, to ensure children using the alternative space are adequately supervised while using that space and while accessing amenities 1

It is a condition of the service waiver that bush kindy excursions take place a minimum of 2 times per week

This service is approved to provide education and care to children from birth up to and including over preschool age, not including school children

The approved provider must ensure that the mirrors installed at the service are constantly maintained and operational. This is to ensure the facilitation of adequate supervision of children at all times they are being educated and cared for at the service, having regard to the need to maintain the rights and dignity of the children, as required under regulation 115 of the Education and Care Services National Regulations.

As part of the requirement to conduct three (3) monthly emergency and evacuation procedures rehearsals in accordance with regulation 97(3) of the Education and Care Services National Regulations the approved provider must, from the date of the initial service approval, engage an appropriate expert in emergency procedures, a fire safety advisor or fire safety engineer to observe and report on one rehearsal (including any proposed actions to improve evacuation procedures) within the first three months of the service’s operation, and then at least annually thereafter. A copy of the initial (within three (3) months) and the annual evacuation outcome report, including any recommendations for actioning, is to be supplied to the Regional Office of the Regulatory Authority in which the service is located within seven (7) days upon receipt of the report by the approved provider

It is a condition of the service waiver that an adequate amount of healthy live plants in a variety of species and sizes is maintained at all times in the alternative space, ensuring children are afforded opportunities to explore and experience the natural environment.
