These are actions taken by the State or Territory regulatory authorities when a service is found to be not complying with National Health and Safety regulations. These actions range in severity and are designed to improve and ensure children’s safety and wellbeing.

What is an enforcement action?

The regulatory authority may amend the provider or service’s approval to operate.

Compliance notices or directions include formal instructions for a service to rectify compliance issues.

Conditions placed on a service or provider approval require the service or provider to undertake specific actions to be compliant.

 – Emergency action notices require immediate steps to be taken by the provider to address serious risks at a service.

 – Enforceable undertakings are legally binding agreements that can be made between a regulatory authority and an approved provider or an individual. They set out what that approved provider or individual agrees to do or refrain from doing to comply with the National Law.

 – In extreme cases, the provider or service may temporarily lose their approval to operate.

Definitions

The Approved Provider must ensure that there are no new enrolments of any children after 8 July 2025 at any approved education and care services that they operate.

The Approved Provider must ensure that all approved services that they operate are staffed with one additional educator than what is required by the Education and Care Services National Regulations from 8 July 2025.

The approved provider is to ensure that at all times enrolled children preschool age or under require access to and from the toilet facilities, they are accompanied and supervised by a contact staff member, including while in the bathroom.

The approved provider must ensure that children are directly supervised as they move between the indoor and the outdoor spaces

The approved provider must ensure that all children attending the outside school hours care program must be at least 4 years of age by 30 June in the year they attend the program.

The service is approved to operate an after school program during the hours of 2.30pm - 6pm during school terms and a vacation care program for a maximum number of 20 school aged children.

This program is to be run in Activity Space 2 whilst the long day care service operates from Activity Space 1. The map of the building showing the approved areas must be displayed adjacent to this service approval.

‘The approved provider must not enrol children younger than 25 months’.
