These are actions taken by the State or Territory regulatory authorities when a service is found to be not complying with National Health and Safety regulations. These actions range in severity and are designed to improve and ensure children’s safety and wellbeing.

What is an enforcement action?

The regulatory authority may amend the provider or service’s approval to operate.

Compliance notices or directions include formal instructions for a service to rectify compliance issues.

Conditions placed on a service or provider approval require the service or provider to undertake specific actions to be compliant.

 – Emergency action notices require immediate steps to be taken by the provider to address serious risks at a service.

 – Enforceable undertakings are legally binding agreements that can be made between a regulatory authority and an approved provider or an individual. They set out what that approved provider or individual agrees to do or refrain from doing to comply with the National Law.

 – In extreme cases, the provider or service may temporarily lose their approval to operate.

What are the different enforcement actions?

Definitions

The Approved Provider must ensure that where children under the age of 7 years are attending excursions outside the premises of the service, staff with specific training or qualifications in educating and caring for children of younger primary school age are in attendance to specifically supervise children under 7 years of age.

This service is approved to provide education and care to children over preschool age up to and including school children, before school, after school and during school holidays.

In addition to the prescribed information required to be displayed under section 172 of the Education and Care Services National Law and regulation 173 of the Education and Care Services National Regulations, the approved provider must display a map which clearly identifies the indoor and outdoor spaces on the school site approved by the school for use by the education and care service. This map is to be positioned so that is clearly visible to anyone from the main entrance to the education and care service premises.

The approved provider must ensure that the education and care service only provides education and care for children over preschool age.

The approved provider must ensure that, for each child being educated and cared for by the service, the education and care service premises has at least 3.19 square metres of unencumbered indoor space.

The approved provider must ensure that, for each child being educated and cared for by the service, the education and care service premises has at least 2.54 square metres of unencumbered indoor space.

In addition to the prescribed information required to be displayed under section 172 of the Education and Care Services National Law and regulation 173 of the Education and Care Services National Regulations, the approved provider must display a map which clearly identifies the indoor and outdoor spaces on the school site approved by the school for use by the education and care service. This service is approved to provide education and care to children over preschool age up to and including school children before school, after school and during school holidays.

This map is to be positioned so that it is clearly visible to anyone from the main entrance to the education and care service premises.

An approved provider of an education and care service that is listed on the Department of Education & Training Category 4 List – at some risk of bushfire or grassfire must ensure that: 
•	The service does not operate on any day that the Victorian Emergency Management Commissioner declares as having a 'Catastrophic' Fire Danger Rating that applies to the area or district at which that service is located.
•	The service's emergency and evacuation policies and procedures required under regulation 168 of the Education and Care Services National Regulations include an Emergency Management Plan for managing the service's bushfire and grass fire related risks.
•	The service's Emergency Management Plan is kept up to date, reflects the service's operating context, is reviewed at least once each calendar year, and includes:
o	a list of the service's emergency contact details
o	procedures for monitoring and managing bushfire and grassfire risks and events
o	procedures for identifying and managing events that may cause planned, unplanned or pre-emptive closure of the service
o	procedures for notifying families of children enrolled at the service of any closure
o	procedures for reviewing and updating the Emergency Management Plan.
•	A copy of the service's Emergency Management Plan is made available to the Regulatory Authority on request.

•	    An approved provider of an education and care service that is listed on the Department of Education & Training Bushfire At-Risk Register must ensure that: 
•	The service does not operate on any day that the Victorian Emergency Management Commissioner declares as having a 'Catastrophic' Fire Danger Rating that applies to the area or district at which that service is located.
•	The service's emergency and evacuation policies and procedures required under regulation 168 of the Education and Care Services National Regulations include an Emergency Management Plan for managing the service's bushfire and grass fire related risks.
•	The service's Emergency Management Plan is kept up to date, reflects the service's operating context, is reviewed at least once each calendar year, and includes:
o	a list of the service's emergency contact details
o	procedures for monitoring and managing bushfire and grassfire risks and events
o	procedures for identifying and managing events that may cause planned, unplanned or pre-emptive closure of the service
o	procedures for notifying families of children enrolled at the service of any closure
o	procedures for reviewing and updating the Emergency Management Plan.

This service approval is granted for the provision of vacation care during school holidays at this location.

No more than one educator who does not meet the qualification requirements of regulation 126(1)(a) can be counted in the educator to child ratios at any one time.

The number of children aged 36 months to preschool age that can be educated and cared for by the service at any one time must not exceed 15 per cent of the total number of approved places or 15 approved places (whichever number is less).
