These are actions taken by the State or Territory regulatory authorities when a service is found to be not complying with National Health and Safety regulations. These actions range in severity and are designed to improve and ensure children’s safety and wellbeing.

What is an enforcement action?

The regulatory authority may amend the provider or service’s approval to operate.

Compliance notices or directions include formal instructions for a service to rectify compliance issues.

Conditions placed on a service or provider approval require the service or provider to undertake specific actions to be compliant.

 – Emergency action notices require immediate steps to be taken by the provider to address serious risks at a service.

 – Enforceable undertakings are legally binding agreements that can be made between a regulatory authority and an approved provider or an individual. They set out what that approved provider or individual agrees to do or refrain from doing to comply with the National Law.

 – In extreme cases, the provider or service may temporarily lose their approval to operate.

What are the different enforcement actions?

Definitions

The approved provider must not hold more than the existing 100 service approvals for the provision of education and care services in NSW. This condition applies from 1 October 2025 and will remain in force until such time as, in respect to its service approvals for NSW education and care services:
a. 95% or more of those services are rated at or above Meeting the National Quality Standard (calculated based on the number of services in NSW that are currently rated and, of those services, the percentage that are rated at Meeting the NQS or above (and rounded to the nearest whole percentage).

In addition to condition 1, the approved provider agrees that in the event that any of its existing services are divested it will not seek to add any education and care services to its existing portfolio until 1 March 2026, to allow it to place an increased focus on compliance and operational improvement across its existing education and care services operating in NSW.

From the date of the commencement of these conditions and every three months thereafter, the approved provider must submit to the Regulatory Authority its Quality Improvement Plans for:
a. each of its NSW education and care services that are rated at Working Towards the National Quality Standard as at 1 October 2025; and 
b. any of its NSW education and care services that are rated at Working Towards the National Quality Standard after 1 October 2025 but before 30 September
2026. This condition excludes any services with an existing rating of Working Towards the National Quality Standards that are acquired by the approved provider after 1 March 2026
These plans must demonstrate progress towards addressing all quality areas rated as Working Towards.

From 1 October 2025 the approved provider must ensure that in each of its NSW education and care services that are rated at Working Towards the National Quality Standards as at 1 October 2025, the educator to child ratios are maintained above the requirements of the National Law as per the following required levels:
a. for children from birth to 24 months of age - 1 educator to 3 children;
b. for children over 24 months of age and less than 36 months of age—1 educator to 4 children; and
c. for children aged 36 months of age or over (not including children over preschool age) - 1 educator to 8 children.
This condition remains in force in respect to each service for a period of 15 months or until such time as the service is re-assessed and achieves a rating of Meeting the 
National Quality Standards or above, whichever is the earlier.

Within three months of the commencement of these conditions the approved provider must submit to the Regulatory Authority for approval a detailed plan to provide additional child safety training to all staff currently working at each of its NSW education and care services. This plan must include:
a. The details of the training provider(s) that will deliver the sessions
b. The content that will be included
c. The specific staff that the training will be delivered to

Upon approval of the detailed plan (see condition 5) the approved provider must provide confirmation that the training has been delivered to all staff currently working at each of its NSW education and care services within six months from the date of approval of the plan

Within three months of the commencement of these conditions the approved provider must submit to the Regulatory Authority a detailed plan documenting a program for the installation of CCTV at all of its NSW education and care services. The approved provider must provide quarterly reports to the Regulatory Authority documenting progress on the installation of CCTV at its NSW education and care services.

•	In addition to compliance with the prescribed educator to child ratio set out in regulation 123 in the Education and Care Service National Regulations 2012, the approved provider must ensure at least 2 educators are present at all times in the Kindy outdoor area working directly with any children in the area, to ensure effective supervision at all times given the layout of the Kindy outdoor area.

•	The approved provider must ensure a register is kept of all maintenance conducted on the premises, furniture and equipment in the outdoor area of the service.

•	The approved provider must ensure the maintenance register is available for inspection by an authorised officer, on the same basis as for any document prescribed for the purpose of section 175 of the National Law.

•	The approved provider must send the Regulatory Authority a copy of the maintenance registers every 6 months from when the conditions come into effect

An approved provider of an education and care service that is listed on the Department of Education Category 4 List – at some risk of bushfire or grassfire must ensure that:  
a. The service does not operate on any day that the Victorian Emergency Management Commissioner declares as having a 'Catastrophic' Fire Danger Rating that applies to the area or district at which that service is located.  
b. The service's emergency and evacuation policies and procedures required under regulation 168 of the Education and Care Services National Regulations include an Emergency Management Plan for managing the service's bushfire and grass fire related risks.
c. The service's Emergency Management Plan is kept up to date, reflects the service's operating context, is reviewed at least once each calendar year, and includes:  
i. a list of the service's emergency contact details  
ii. procedures for monitoring and managing bushfire and grassfire risks and events  
iii. procedures for identifying and managing events that may cause planned, unplanned or pre-emptive closure of the service  
iv. procedures for notifying families of children enrolled at the service of any closure  
v. procedures for reviewing and updating the Emergency Management Plan.  
d. A copy of the service's Emergency Management Plan is made available to the Regulatory Authority on request.

The approved provider must ensure that no outdoor play equipment on the first floor is placed within 1.9m of the perimeter fencing.

The service is approved to provide education and care to children from birth up to and including school children

The service is approved to provide education and care to a maximum of 15 school children

The mirrors, CCTV and monitors installed at the service are constantly maintained and operational to ensure the facilitation of supervision of children at all times they are being educated and cared for at the service, having regard to the need to maintain the rights and dignity of the children as required under regulation 115 of the Education and Care Services National Regulations

It is a condition of the service waiver that the Approved Provider must comply with regulation 113 of the Education and Care Services National Regulations in relation to the unencumbered outdoor space.

The Approved Provider is required to ensure objects are not placed in a manner that may allow a child to climb over barriers or fences, and all play equipment in the outdoor play spaces is maintained and placed to meet the requirements of the Australian Playground Standards (Standard AS 4685:2014) with particular consideration given to falling space, impact areas and free space.

The Approved Provider must ensure that they incorporate and maintain natural elements and features within outdoor spaces.

This service is approved to provide education and care to children from birth to over preschool age, including school children.

This service is approved to provide education and care to children from birth up to and including over preschool age, not including school children.

This service is approved to provide education and care to children from birth up to and including school children.

The Approved Provider is required to ensure objects are not placed in a manner that may allow a child to climb over barriers or fences; and, all play equipment in the outdoor play spaces are maintained and placed in a way that meets the requirements of the Australian Playground Standards (Standard AS 4685:2014) with particular consideration given to falling space, impact areas and free space, in the upper outdoor space where cement and glass fencing is used.

A person who is a suitably qualified person as determined by ACECQA may be taken to be an early childhood teacher for the purposes of regulation 132.
•	The approved provider must engage with an Early Childhood Teacher for the purposes of developing and implementing the education program being delivered to children being educated and cared for at this service. 
•	The approved provider must take reasonable steps to recruit an early childhood teacher during the waiver period 
•	The approved provider must notify the Regulatory Authority within 14 days if the waiver is no longer required

A person who holds an approved diploma-level qualification may be taken to be an early childhood teacher for the purposes of regulation 133(1)(a).

The approved provider must engage with an Early Childhood Teacher for the purposes of developing and implementing the education program being delivered to children being educated and cared for at this service.

The approved provider must take reasonable steps to recruit an early childhood teacher during the waiver period

The approved provider must notify the Regulatory Authority within 14 days if the waiver is no longer required

This service is approved to provide education and care to children from birth up to and including over preschool age.

The service is not approved to provide education and care to school children.

The mirrors installed at the service are constantly maintained and operational to ensure the facilitation of supervision of children at all times they are being educated and cared for at the service, having regard to the need to maintain the rights and dignity of the children as required under regulation 115 of the Education and Care Services National Regulations.

The service must have at least 7 square metres enclosed outdoor space for each child being educated and care for

To ensure ongoing compliance with natural environment requirements under regulation 113 of the National Regulations, the service is required to maintain or increase the current number of healthy live plants in a variety of species and sizes in the enclosed outdoor space of the premises.

This service is approved to provide education and care to children from birth up to and including preschool age, not including school children.

The Approved Provider for this service must not provide education and care for more than twelve (12) non-ambulant infants at any one time.

The Approved Provider must ensure that no climbable outdoor play equipment or climbable natural vegetation is placed within one (1) metre of the perimeter fencing in the children's outdoor play space.

Staff responsible for evacuating children aged 2-3 years are not to be responsible for evacuating any other children.

Staff responsible for evacuating non-ambulant infants are not to be responsible for evacuating any other children, other than children who are 3-5 years old.

As part of the requirement to conduct three (3) monthly emergency and evacuation procedures rehearsals in accordance with regulation 97(3) of the Education and Care Services National Regulations, the Approved Provider must, from the date of the initial service approval, engage an appropriate expert such as a person/entity holding a Queensland Building and Construction Commission licence in emergency procedures, a fire safety advisor or fire safety engineer to observe and report on one rehearsal (including any proposed actions to improve evacuation procedures) within the first three (3) months of the service’s operation, and then at least annually thereafter.

A copy of the initial (within three (3) months) and the annual evacuation outcome report including any recommendations for actioning is to be supplied to the Regional Office of the Regulatory Authority in which the service is located within seven (7) days upon receipt of the report by the Approved Provider.

The mirrors, closed circuit cameras and monitors installed at the service are constantly maintained and operational (in rooms where education and care is being provided to children) to ensure the facilitation of adequate supervision of children at all times having regard to the need to maintain the rights and dignity of the children as required under regulation 115 of the Education and Care Services National Regulations.

The approved provider must ensure that the number of children preschool age or under being educated and cared for at the one time at the service is no more than 90.

The service is approved to provide education and care to a maximum of 15 school children.

•	The Service must actively advertise to fill the ECT position for the duration of the wavier and provide evidence of such on request.

Condition 1 Regulation 107 – The maximum approved number of children per room must not exceed:
o Baby 1: 12 children Baby 2: 12 children Toddler 1: 12 children
o Toddler 2: 20 children Toddler 3: 20 children Junior 1: 20 children
o Junior 2: 22 children Senior 1: 33 children

Condition 2
For the additional 16 children to be approved to utilise the Baby and Toddler rooms, and an additional 22 children to be approved to utilise the Junior and Senior rooms beyond the indoor space requirements, the service must utilise the verandah spaces as indoor space

Condition 3
For condition 2 to be met -
o the service must consider how the use and set up of this space connects to the indoor environment and how they will provide children greater access to unencumbered space to avoid overcrowding within the indoor rooms.
o In doing so the service must consider how all children, including non-ambulatory children have access to sufficient unencumbered space in both an indoor and outdoor environment.
o The service must ensure a process is in place that considers how all educators will be aware of the way in which the indoor space

The approved provider must ensure that the number of children preschool age or under being educated and cared for at any one time at the service is no more than 108.

The approved provider must ensure that the number of children preschool age or under being educated and cared for at any one time at the service is no more than 131.

This service is approved to provide education and care to children from birth up to and including school age which may include a maximum of 15 school children.

This service is approved to provide education and care to children aged from birth up to and including school children which may include a maximum of 15 school children.

An approved provider of an education and care service that is listed on the Department of Education Category 4 List – at some risk of bushfire or grassfire must ensure that:

d.	A copy of the service's Emergency Management Plan is made available to the Regulatory Authority on request.

This is a multi-level service and it is recommended service approval is granted subject to the following conditions;

The Approved Provider is required to ensure objects are not placed in a manner that may allow a child to climb over barriers or fences; and, all play equipment in the outdoor play spaces are maintained and placed in a way that meets the requirements of the Australian Playground Standards (Standard AS 4685:2014) with particular consideration given to falling space, impact areas and free space.

The Approved Provider must ensure that the level 1 ‘staff balcony’ must not be accessed by children at any time.

The Approved Provider must engage an appropriate expert such as fire safety advisor or fire safety engineer to observe and prepare a report on the emergency and evacuation procedure rehearsal of the service. This must occur at the first rehearsal of the emergency and evacuation procedure. The report prepared must identify:
•	the service;
•	the date and time of the rehearsal;
•	the total time taken to evacuate the building;
•	the location to which building occupants were evacuated to;
•	the number of children and educators in attendance on the day;
•	the profile of children (ages, any disabilities) with respect to the children's rooms operating at the time of the rehearsal; and
•	any proposed actions the service must take to improve evacuation procedures to ensure the safety of all children attending the service.
•	The approved provider must submit a copy of any report produced in relation this condition to the Regional Office of the Regulatory Authority in which the service is located within seven (7) days of receipt.

1.	Prior to 30 July 2025, and every six months thereafter, the approved provider must ensure that refresher training is conducted for all educators and staff working at the Service on the following policies and procedures required under regulation 168:
a.	Incident, injury trauma and illness procedures complying with regulation 85.
b.	Providing a child safe environment, including matters relating to the promotion of a culture of child safety and wellbeing, child protection awareness and mandatory reporting requirements.
c.	Interactions with children, including matters set out in regulation 155 and 156.
d.	Dealing with complaints, including matters relating to the provision of complaint handling systems that are child focused.
The approved provider must submit evidence to the Regulatory Authority within one week of completion of the initial refresher training and each subsequent refresher training.
This condition will be in place for an initial period of 24 months and will be reviewed by the Regulatory Authority at that time

3.	From 19 May 2025 the approved provider must ensure that:
a.	any allegations or incidents involving physical or sexual abuse of a child in education and care at the Service
b.	any circumstance arising at the Service that poses a risk to the health, safety or wellbeing of a child
are reported to the Regulatory Authority as soon as practicable, but not later than 24 hours, of the matter being reported to an educator, nominated supervisor, or area manager at the Service.

4.	The approved provider must: 
a.	Prepare a compliance improvement plan and submit a copy of that plan to the Regulatory Authority by 30 June 2025. 
b.	Ensure that the compliance improvement plan addresses the following:  
i.	Adequate supervision of children, consistent with section 165 of the National Law. 
ii.	Taking reasonable precautions to protect children from harm or hazards, consistent with section 167 of the National Law. 
iii.	Ensuring certain information is notified to the Regulatory Authority within prescribed timeframes, consistent with section 174 of the National Law.
c.	Ensure that the Compliance Improvement Plan contains, as a minimum, the following details:  
i.	relevant section/regulation;    
ii.	planned compliance improvement actions;  
iii.	how the provider will monitor its own compliance and improvement actions;
iv.	how the provider will ensure that parent complaints are appropriately addressed 
v.	Improvement action taken;  
vi.	date of action taken; and 
vii.	name and signature of person taking action.  
d.	Submit a copy of the compliance improvement plan to the Regulatory Authority on a quarterly basis, commencing on 30 June 2025, with an update on progress. 
This condition will be in place for an initial period of 12 months and will be reviewed by the Regulatory Authority at that time.

6.	The approved provider must notify all families in writing of any future compliance actions they receive from the Regulatory Authority within 7 days of receipt and provide a copy of this notice to the Regulatory Authority at the time of issuing.

The Approved Provider must ensure that the mirrors installed at the service are constantly maintained and operational to ensure the facilitation of adequate supervision of children at all times they are being educated and cared for at the service, having regard to the need to maintain the rights and dignity of the children as required under regulation 115 of the Education and Care Services National Regulations.

The Approved Provider is required to ensure objects are not placed in a manner that may allow a child to climb over barriers or fences in Outdoor Area 3

This is a multi-level service and it is recommended that the service approval is granted subject to the following conditions:
   •	The Approved Provider is required to ensure objects are not placed in a manner that may allow a child to climb over barriers or fences; and, all play equipment in the outdoor play spaces are maintained and placed in a way that meets the requirements of the Australian Playground Standards (Standard AS 4685) with particular consideration given to falling space, impact areas and free space.
   •   The approved provider must ensure that they incorporate and maintain natural elements and features within outdoor spaces.
   •   The approved provider must ensure that all staff have read and are familiar with the supervision plan and risk assessment for the outdoor space.

•	The Approved Provider must engage an appropriate expert such as a fire safety advisor or fire safety engineer to observe and prepare a report on the emergency and evacuation procedure rehearsal of the service. This must occur at the first rehearsal of the emergency and evacuation procedure. The report prepared must identify:
a.	the service;
b.	the date and time of the rehearsal;
c.	the total time taken to evacuate the building;
d.	the location to which building occupants were evacuated to;
e.	the number of children and educators in attendance on the day;
f.	the profile of children (ages, any disabilities) with respect to the children’s rooms operating at the time of the rehearsal; and
g.	any proposed actions the service must take to improve evacuation procedures to ensure the safety of all children attending the service.
•	The approved provider must submit a copy of any report produced in relation this condition to the Regional Office of the Regulatory Authority in which the service is located within seven (7) days of receipt.

This service is approved to provide education and care to a maximum of 15 school children at any one time.

The Approved Provider must ensure that the mirrors installed at the service are constantly maintained and operational.
