These are actions taken by the State or Territory regulatory authorities when a service is found to be not complying with National Health and Safety regulations. These actions range in severity and are designed to improve and ensure children’s safety and wellbeing.

What is an enforcement action?

The regulatory authority may amend the provider or service’s approval to operate.

Compliance notices or directions include formal instructions for a service to rectify compliance issues.

Conditions placed on a service or provider approval require the service or provider to undertake specific actions to be compliant.

 – Emergency action notices require immediate steps to be taken by the provider to address serious risks at a service.

 – Enforceable undertakings are legally binding agreements that can be made between a regulatory authority and an approved provider or an individual. They set out what that approved provider or individual agrees to do or refrain from doing to comply with the National Law.

 – In extreme cases, the provider or service may temporarily lose their approval to operate.

Definitions

The provider must submit, every two months, evidence to the ACT Regulatory Authority of the occupancy rate and staffing of their ACT services.

The provider must provide quarterly financial management report or the like to show bills are paid on time for ACT services.

The provider must consult the ACT Regulatory Authority on proposed new person with management or control.

Nominated supervisor(s) for each ACT service operated by the provider must be physically located in the ACT.

Any area manager appointed to oversee the operation of ACT services by the provider must be physically located in the ACT.

The provider must have a person with management or control who holds tertiary early childhood qualifications and who is responsible for the quality of child development and pedagogy.

This service is approved to provide education and care to children from birth up to and including over preschool age, not including school children.

The approved provider must not provide education and care for more than 18 non-ambulant infants on the ground level at the service.

The approved provider must ensure that no outdoor play equipment or natural vegetation is placed within one metre of the perimeter fencing of any children's outdoor play space including on both the ground level and lower ground level and/or any of the glass fencing around the internal void on the ground level.

It is a condition of the service waiver that the approved provider must utilise 134m² of covered space outside of the playrooms 1, 2 & 3 on ground level and 191m2 of covered space outside of playrooms 6 and 7 on lower ground level, to satisfy part of the unencumbered outdoor space requirements.

It is a condition of the service waiver, that the approved provider is approved to provide education and care to a maximum of 68 children in the outdoor play spaces on the ground level.

It is a condition of the service waiver that the approved provider must ensure that an adequate amount of healthy, live plants in a variety of species and sizes is maintained at all times, in the alternative covered spaces of the service premises, ensuring children are afforded opportunities to explore and experience the natural environment.

The Approved Provider is required to ensure objects are not placed in a manner that may allow a child to climb over barriers or fences; and all play equipment in the outdoor play spaces are maintained and placed in a way that meets the requirements of the Australian Playground Standards (Standard AS 4685) with particular consideration given to falling space, impact areas and free space.
