These are actions taken by the State or Territory regulatory authorities when a service is found to be not complying with National Health and Safety regulations. These actions range in severity and are designed to improve and ensure children’s safety and wellbeing.

What is an enforcement action?

The regulatory authority may amend the provider or service’s approval to operate.

Compliance notices or directions include formal instructions for a service to rectify compliance issues.

Conditions placed on a service or provider approval require the service or provider to undertake specific actions to be compliant.

 – Emergency action notices require immediate steps to be taken by the provider to address serious risks at a service.

 – Enforceable undertakings are legally binding agreements that can be made between a regulatory authority and an approved provider or an individual. They set out what that approved provider or individual agrees to do or refrain from doing to comply with the National Law.

 – In extreme cases, the provider or service may temporarily lose their approval to operate.

Definitions

Service approval is granted subject to the condition that the maximum number of children in attendance is 22 during the following operational times;&#xD;
Before school care; Thursday for after school care; Wednesday and Thursday during vacation care.

The approved provider must ensure that all children attending the outside school hours care program must be at least 4 years of age by 30 June in the year they attend the program.

The approved provider must ensure that only children who are currently enrolled in, and attend or will attend, a school in the current year attend the outside school hours care program.

The approved provider is to ensure that at all times enrolled children preschool age or under require access to and from the toilet facilities, they are accompanied and supervised by a contact staff member, including while in the bathroom.
