From 5 January 2026, all CCS eligible families can get at least 72 hours of subsidised care per fortnight. These changes are known as the 3 Day Guarantee.

Approved children's education and care services across Australia are assessed and rated by their state and territory regulatory authority. The NQS is part of the National Regulations and includes seven quality areas that are important to children's learning and developmental outcomes.

These are actions taken by the State or Territory regulatory authorities when a service is found to be not complying with National Health and Safety regulations. These actions range in severity and are designed to improve and ensure children’s safety and wellbeing.

What is an enforcement action?

The regulatory authority may amend the provider or service’s approval to operate.

Compliance notices or directions include formal instructions for a service to rectify compliance issues.

Conditions placed on a service or provider approval require the service or provider to undertake specific actions to be compliant.

 – Emergency action notices require immediate steps to be taken by the provider to address serious risks at a service.

 – Enforceable undertakings are legally binding agreements that can be made between a regulatory authority and an approved provider or an individual. They set out what that approved provider or individual agrees to do or refrain from doing to comply with the National Law.

 – In extreme cases, the provider or service may temporarily lose their approval to operate.

The approved provider must ensure that the maximum number of family day care educators employed or engaged by the service does not exceed 12.

The approved provider must employ at least 1 full time family day care co-ordinator for every 15 family day care educators providing education and care to children.

The approved provider must notify the Regulatory Authority within 5 days of commencing operation of the family day care service.

The approved provider within 5 days of commencement of the operation of the family day care service must submit to the Regulatory Authority: 
•	a copy of the register of family day care educators that complies with section 269 of the Education and Care Services National Law Act 2010 and regulation 153 of the Education and Care Services National Regulations 2011.
•	a copy of the staff records that complies with regulation 154 of the Education and Care Services National Regulations 2011 for each of the persons appointed as a family day care co-ordinator to monitor and support family day care educators.
