You may be exempt from the Child Care Subsidy activity test if you are the principal carer of your grandchild, unable to work due to a disability or medical condition, or a Carer Payment recipient.
Aboriginal and Torres Strait Islander children may be entitled to a minimum of 36 hours of subsidised care, regardless of activity levels. Low income families may be entitled to a minimum of 24 hours of subsidised care per fortnight, regardless of activity levels.

These are actions taken by the State or Territory regulatory authorities when a service is found to be not complying with National Health and Safety regulations. These actions range in severity and are designed to improve and ensure children’s safety and wellbeing.

What is an enforcement action?

The regulatory authority may amend the provider or service’s approval to operate.

Compliance notices or directions include formal instructions for a service to rectify compliance issues.

Conditions placed on a service or provider approval require the service or provider to undertake specific actions to be compliant.

 – Emergency action notices require immediate steps to be taken by the provider to address serious risks at a service.

 – Enforceable undertakings are legally binding agreements that can be made between a regulatory authority and an approved provider or an individual. They set out what that approved provider or individual agrees to do or refrain from doing to comply with the National Law.

 – In extreme cases, the provider or service may temporarily lose their approval to operate.

The approved provider must ensure that the number of family day care educators employed, engaged or registered with the service does not exceed 75

1. The temporary waiver of regulation 124(3) is only to be applied to the residences at 38 Cotton Street, Latrobe Tasmania, and 102 Mersey Main Road, Spreyton Tasmania. 
2. The approved provider is required to provide the Tasmanian Regulatory Authority with documented strategies and a supporting action plan by 30 November 2025, 
detailing how the existing dual educator models operating at residences: 38 Cotton Street, Latrobe Tasmania, and 102 Mersey Main Road, Spreyton Tasmania, will become compliant with legislative requirements currently in force under the National Quality Framework.
3. The approved provider is required to take every reasonable step to implement the strategies and action plan as determined from condition 2.
4. The approved provider is required to provide documented evidence of its implementation and an updated action plan to the Tasmanian Regulatory Authority on a fortnightly schedule.
