From 5 January 2026, all CCS eligible families can get at least 72 hours of subsidised care per fortnight. These changes are known as the 3 Day Guarantee.

Approved children's education and care services across Australia are assessed and rated by their state and territory regulatory authority. The NQS is part of the National Regulations and includes seven quality areas that are important to children's learning and developmental outcomes.

These are actions taken by the State or Territory regulatory authorities when a service is found to be not complying with National Health and Safety regulations. These actions range in severity and are designed to improve and ensure children’s safety and wellbeing.

What is an enforcement action?

The regulatory authority may amend the provider or service’s approval to operate.

Compliance notices or directions include formal instructions for a service to rectify compliance issues.

Conditions placed on a service or provider approval require the service or provider to undertake specific actions to be compliant.

 – Emergency action notices require immediate steps to be taken by the provider to address serious risks at a service.

 – Enforceable undertakings are legally binding agreements that can be made between a regulatory authority and an approved provider or an individual. They set out what that approved provider or individual agrees to do or refrain from doing to comply with the National Law.

 – In extreme cases, the provider or service may temporarily lose their approval to operate.

The approved provider is required to ensure that this waiver of regulation 124(1) is applied to educator Mindy Van Donselaar only, in the circumstances applied for in the waiver application.

The approved provider is required to ensure that an assistant educator is present providing education and care to children at all times that the number of children enrolled and attending the service with educator Melinda Van Donselaar exceeds 4 children under preschool age.

The approved provider is required to ensure that educator Melinda van Donselaar does not accept any additional children into care over and above the details provided in the waiver application, including in the event that an enrolled child does not attend care. This is relevant at all times that the number of children under preschool age exceeds 4.

The approved provider is to continue to work towards achieving compliance with regulation 124(1) and remove the need for the waiver through supporting families to seek suitable alternative care.

The maximum number of family day care educators that may be employed or engaged by the approved provider under this service approval is 100
