These are actions taken by the State or Territory regulatory authorities when a service is found to be not complying with National Health and Safety regulations. These actions range in severity and are designed to improve and ensure children’s safety and wellbeing.

What is an enforcement action?

The regulatory authority may amend the provider or service’s approval to operate.

Compliance notices or directions include formal instructions for a service to rectify compliance issues.

Conditions placed on a service or provider approval require the service or provider to undertake specific actions to be compliant.

 – Emergency action notices require immediate steps to be taken by the provider to address serious risks at a service.

 – Enforceable undertakings are legally binding agreements that can be made between a regulatory authority and an approved provider or an individual. They set out what that approved provider or individual agrees to do or refrain from doing to comply with the National Law.

 – In extreme cases, the provider or service may temporarily lose their approval to operate.

Definitions

•     An approved provider of an education and care service that is listed on the Department of Education & Training Category 4 List – at some risk of bushfire or grassfire must ensure that: •	The service does not operate on any day that the Victorian Emergency Management Commissioner declares as having a 'Catastrophic' Fire Danger Rating that applies to the area or district at which that service is located.
•	The service's emergency and evacuation policies and procedures required under regulation 168 of the Education and Care Services National Regulations include an Emergency Management Plan for managing the service's bushfire and grass fire related risks.
•	The service's Emergency Management Plan is kept up to date, reflects the service's operating context, is reviewed at least once each calendar year, and includes:
o	a list of the service's emergency contact details
o	procedures for monitoring and managing bushfire and grassfire risks and events
o	procedures for identifying and managing events that may cause planned, unplanned or pre-emptive closure of the service
o	procedures for notifying families of children enrolled at the service of any closure
o	procedures for reviewing and updating the Emergency Management Plan.
•	A copy of the service's Emergency Management Plan is made available to the Regulatory Authority on request.

•	    An approved provider of an education and care service that is listed on the Department of Education & Training Bushfire At-Risk Register must ensure that: 
•	The service does not operate on any day that the Victorian Emergency Management Commissioner declares as having a 'Catastrophic' Fire Danger Rating that applies to the area or district at which that service is located.
•	The service's emergency and evacuation policies and procedures required under regulation 168 of the Education and Care Services National Regulations include an Emergency Management Plan for managing the service's bushfire and grass fire related risks.
•	The service's Emergency Management Plan is kept up to date, reflects the service's operating context, is reviewed at least once each calendar year, and includes:
o	a list of the service's emergency contact details

a person who holds an approved diploma-level qualification/who is a suitably qualified person as determined by ACECQA may be taken to be an early childhood teacher for the purposes of regulation 132 

The approved provider must engage with an Early Childhood Teacher for the purposes of developing and implementing the education program being delivered to children being educated and cared for at this service 

The approved provider must take reasonable steps to recruit an early childhood teacher during the waiver period 

The approved provider must notify the Regulatory Authority within 14 days if the waiver is no longer required

The waiver for regulation 126(1)(a) applies on a maximum of one day per week during educator’s lunch breaks only. During this period of time, one educator who holds an approved certificate III qualification as listed on ACECQA can be counted in the ratios of Diploma qualified educators.

The approved provider must take reasonable steps to recruit educators who have, or are actively working towards, at least an approved diploma level education and care qualification.

The approved provider must notify the Regulatory Authority within 14 days if the waiver is no longer required.

The Approved Provider is required to ensure objects are not placed in a manner that may allow a child to climb over barriers or fences.
The Approved Provider is required to ensure all equipment in the outdoor play spaces are maintained and placed in a way that meets the requirements of the Australian Playground Standards (Standard AS 4685), with particular consideration given to falling space, impact areas and free space.

The approved provider must ensure that no further enrolments are accepted by the education and care service, with the exception of the child specified in the waiver application whilst this waiver is in effect.

The approved provider must engage two educators and may educate and care for no more than 23 children aged 36 months of age to preschool age on a maximum of three days per week.

The maximum number of children that can be educated and cared for when the pre-kindergarten room and pre-kindergarten outdoor space are not available for use by the service is 33.

The early childhood teacher on their prescribed lunch break must be replaced by an educator to maintain the required educator to child ratios.

The early childhood teacher must remain on the premises of the service and be directly and immediately available to care for children as the need arises.
